General Terms and Conditions of Sale and Use
1 General Information and Ownership

Access to and use of the Site, as well as any purchase made, are governed by these General Conditions. The Customer is required to read them carefully before confirming any order.
2 Subject and Conclusion of the Contract
2.1. Subject matter: These Conditions relate to the purchase of technical products and services made remotely through the electronic catalog of the Site.
2.2. Purchase Proposal: The publication of products on the Site constitutes an invitation to offer. The submission of the order by the Customer constitutes a contractual proposal and implies full acceptance of these terms.
2.3. Acceptance and Conclusion: The contract is considered concluded when Technofluid sends the explicit acceptance confirmation or, in the absence of contrary communications, it is tacitly accepted after 96 hours from the order submission. In the case of bank transfer, the commitment starts from the receipt of the payment proof; for electronic payments (PayPal/Cards), from the positive confirmation of the transaction.
3 Content, Images and Technical Responsibility
3.1. Pledge of Allegiance: Technofluid invests constant resources to ensure that data sheets, images and product descriptions are as accurate, faithful and up-to-date as possible.
3.2. Informative nature: However, as these materials are often derived from the manufacturers or transcription processes, the contents are made available for information purposes only. Slight aesthetic or technical variations that do not affect functionality do not constitute a defect. The customer is invited to check in advance that the product meets his specific technical requirements by contacting our office at info@technofluid.it.
Amendments to the Catalogue: Technofluid reserves the right to change or eliminate products at any time for logistical or production requirements, undertaking to promptly report such changes on the Site.
4 Prices and Availability
4.1. Exposure Prices: Unless otherwise indicated, all prices are in Euro (€) and are understood to be VAT EXCLUDED. The tax will be calculated and displayed in the final summary before confirmation.
4.2. Availability Management: Product availability is not updated in real time. In case of simultaneous accesses or sudden unavailability, Technofluid will promptly communicate the estimated delivery times. The Customer may choose whether to accept the new timing or request the cancellation of the order.
4.3. Errors and Variations: Technofluid reserves the right to cancel orders related to clearly incorrect prices (technical errors). If the actual price is higher than that indicated on the Site, the Customer will be informed and may decide whether to confirm the purchase at the new price or cancel it without penalty.
5 Payment Methods and Invoicing
5.1. Accepted Methods: Credit/Debit Cards, PayPal, Advance Bank Transfer, Klarna, and Cash on Delivery (only for orders up to € 500.00). Once the purchase is completed, the chosen method can only be changed following a request to info@technofluid.it by agreement between the parties.
5.2. Invoicing: Invoices are issued in electronic format and sent by e-mail or through regulatory interchange channels.
5.3. Reservation of Title (Art. 1523 of the Civil Code): The products remain the exclusive property of Technofluid until full payment of the price. In case of delay, Technofluid may suspend supplies and late payment interest will be applied pursuant to Legislative Decree 231/02.
6 Shipping and Delivery
6.1. Tariffs Italy:
- Free for orders over € 150.00 (VAT included).
- € 14,99 for orders below the threshold (Peninsula and Sardinia).
- € 9,99 preferential tariff for Sicily.
- Collection at Headquarters: Free at our warehouse, upon notification of "goods ready".
6.2. Delivery Obligations: The Customer is required to check the number of packages and the integrity of the packaging. In case of obvious damage (wet, tampered, crushed package), it is mandatory to write "ACCEPTED WITH SPECIFIC RESERVE" describing the anomaly. Without such reservation, Technofluid cannot claim against the courier nor compensate for the damage.
6.3. Passing the Risk: Freight collect, the goods are insured by Technofluid. In carriage forward, the risk and damage shall be borne entirely by the Customer's carrier.
7 Right of Withdrawal (Consumer Customer)
7.1. Time limits: The consumer (B2C) has the right to withdraw within 14 working days since delivery.
7.2 Critical Exclusions: Withdrawal is excluded for:
- Tailor-made or customised products.
- Products by the metre (tubes, ropes, chains cut to the required size).
- Out-of-catalogue products ordered expressly for the Customer.
- Open sealed products or registered/activated devices.
7.3. Economic Adjustments: Return costs are borne by the Customer. If the return causes the order to fall below the free shipping threshold, Technofluid will charge the Customer the cost of the original shipping not previously paid.
8 Warranty and Limitation of Liability
8.1. Legal Warranty: 24 months for Consumers (B2C), 12 months for Professionals (B2B). The warranty only covers original conformity defects, not damage due to wear and tear, misuse or incorrect installation.
8.2. Limitation of Damage: Technofluid's liability is limited exclusively to the repair or replacement of the defective component. Any reimbursement for labor costs, machine downtime, hauling, launching, travel expenses, or indirect damages resulting from the use of the product is excluded.
8.3. Consulting Errors and Substitutions: If, following technical advice provided by Technofluid, the purchased product is found to be unsuitable, Technofluid will proceed with the replacement of the item. The shipment of the replacement product will occur only after the return and verification of the integrity of the incorrect product at our warehouses, unless otherwise agreed in writing between the parties. It is understood that the returned product must be returned in the same condition as received, complete with original packaging and not installed.
9 Limitation of Liability and Force Majeure
9.1. Continuity of Service: Technofluid adopts the best technologies to ensure service continuity and site accuracy. However, it cannot be held responsible for internet network malfunctions or third-party technical problems that prevent the correct completion of the order.
9.2 Unforeseeable Events: If delivery becomes temporarily impossible or excessively burdensome due to force majeure causes (e.g., strikes, lockouts, fires, or serious supplier delays), the delivery terms will be extended for the duration of the impediment. In such extreme cases, Technofluid will promptly inform the Customer.
10 Intellectual Property, Privacy, and Jurisdiction
10.1. Intellectual Property and Third Party Trademarks: The design, layout, logo and original texts of the Site are the exclusive property of Technofluid S.r.l.
- Contents of Third Parties: Product images, trademarks, datasheets and supplier logos belong to their respective owners and are used by Technofluid for illustrative and informational purposes only, by virtue of existing business relationships.
- Prohibitions: The reproduction, extraction, or unauthorized use of any material on the Site (whether belonging to Technofluid or third parties) for commercial or advertising purposes without prior written consent of the rights holders is prohibited.
10.2. Privacy and Data Processing (GDPR): The processing of the Customer's personal data is carried out in full compliance with EU Regulation 2016/679 (GDPR). The data provided is used exclusively for contract execution, invoicing, and logistics.
The data controller is Technofluid S.r.l.
To know the complete list of their rights (access, correction, deletion) and the processing methods, the Customer is invited to consult the Privacy Policy integral part of the Site.
10.3. Applicable Law and Jurisdiction: Any contract of sale concluded through the Site is governed by Italian law. In the event of disputes that cannot be settled amicably:
- Professional (B2B) and foreign customers: For any dispute arising from the interpretation, execution, or termination of the contract, the Court of Messina has exclusive jurisdiction.
- Consumers (B2C): Pursuant to the Consumer Code, the mandatory territorial jurisdiction is of the court of the place of residence or domicile of the consumer, if located in the territory of the State.
