Terms and Conditions

This website www.technofluid.it is the exclusive property of Technofluid S.r.l., with registered and operational headquarters at Via Galileo Galilei 52 - Z.A. Lot 22 - 98051 Barcellona Pozzo di Gotto (ME) - Italy.

Access to and use of the Site, as well as any purchase made, are governed by these General Terms and Conditions. The Customer must read them carefully before confirming any order.

2.1. Subject matter: These Conditions apply to the purchase of technical products and services made at a distance via the electronic catalogue on the Site.

2.2. Purchase Proposal: The publication of products on the Site constitutes an invitation to offer. The placing of an order by the Customer has the value of a contractual proposal and implies full acceptance of these terms.

2.3. Acceptance and Conclusion: The contract shall be considered concluded when Technofluid sends confirmation of explicit acceptance or, in the absence of communication to the contrary, shall be considered tacitly accepted 96 hours after the order has been sent. In the case of bank transfer, the commitment shall commence upon receipt of proof of payment; for electronic payments (PayPal/Card), upon positive confirmation of the transaction.

3.1. Pledge of Allegiance: Technofluid invests constant resources to ensure that data sheets, images and product descriptions are as accurate, faithful and up-to-date as possible.

3.2. Informative nature: However, as these materials are often derived from the manufacturers or transcription processes, the contents are made available for information purposes only. Slight aesthetic or technical variations that do not affect functionality do not constitute a defect. The customer is invited to check in advance that the product meets his specific technical requirements by contacting our office at info@technofluid.it.

Amendments to the Catalogue: Technofluid reserves the right to change or eliminate products at any time for logistical or production requirements, undertaking to promptly report such changes on the Site.

4.1. Exposure Prices: Unless otherwise indicated, all prices are in Euro (€) and are understood to be VAT EXCLUDED. The tax will be calculated and displayed in the final summary before confirmation.

4.2. Availability Management: Product availability is not updated in real time. In the event of simultaneous access or sudden unavailability, Technofluid shall promptly communicate the estimated delivery time. The Customer will be able to choose whether to accept the new timing or request cancellation of the order.

4.3. Errors and Variations: Technofluid reserves the right to cancel orders related to clearly erroneous prices (technical errors). If the actual price is higher than the price indicated on the Site, the Customer shall be informed and may decide whether to confirm the purchase at the new price or cancel it without penalty.

5.1. Accepted Methods: Credit/Debit Cards, PayPal, Bank Transfer in Advance, Klarna, and Cash on Delivery (only for orders up to € 500.00). Once the purchase has been finalised, the chosen method can only be changed following a request to info@technofluid.it in agreement between the parties.

5.2. Invoicing: Invoices are issued in electronic format and sent by e-mail or through regulatory interchange channels.

5.3. Reservation of Title (Art. 1523 of the Civil Code): Products shall remain the exclusive property of Technofluid until the price is paid in full. In the event of delay, Technofluid may suspend supplies and default interest shall be applied pursuant to Legislative Decree 231/02.

6.1. Tariffs Italy:

• Free for orders over € 150.00 (VAT included).
• € 14,99 for orders below the threshold (Peninsula and Sardinia).
• € 9,99 preferential tariff for Sicily.
• Collection at Headquarters: Free of charge at our warehouse, subject to notification of “goods ready”.

6.2. Delivery Obligations: The customer is obliged to check the number of packages and the integrity of the packaging. In the event of obvious damage (wet, tampered, crushed package), it is imperative to mark “ACCEPTED WITH SPECIFIC RESERVATION” describing the anomaly. Without this reservation, Technofluid shall not be able to claim against the courier or compensate for the damage.

6.3. Passing the Risk: Freight collect, the goods are insured by Technofluid. In carriage forward, the risk and damage shall be borne entirely by the Customer's carrier.

7.1. Time limits: The consumer (B2C) has the right to withdraw within 14 working days since delivery.

7.2 Critical Exclusions: Withdrawal is excluded for:

• Tailor-made or customised products.
• Products by the metre (tubes, ropes, chains cut to the required size).
• Out-of-catalogue products ordered expressly for the Customer.
• Open sealed products or registered/activated devices.

7.3. Economic Adjustments: Return costs shall be borne by the Customer. If the return causes the order to fall below the free shipping threshold, Technofluid shall charge the Customer the cost of the original shipment not previously paid for.

8.1. Legal Warranty: 24 months for Consumers (B2C), 12 months for Professionals (B2B). The warranty only covers original conformity defects, not damage due to wear and tear, misuse or incorrect installation.

8.2. Limitation of Damage: Technofluid's liability is limited exclusively to the repair or replacement of the defective component. Any reimbursement for labour costs, downtime, hauling, launching, travel or consequential damages resulting from the use of the product is excluded.

8.3. Consulting Errors and Substitutions: If, following technical advice provided by Technofluid, the purchased product turns out to be unsuitable, Technofluid shall proceed to replace the good. Shipment of the replacement product shall take place exclusively following the return and verification of the integrity of the faulty product at our warehouses, unless otherwise agreed in writing between the parties. It is understood that the returned product must be returned in the same conditions in which it was received, complete with original packaging and not installed.

9.1. Continuity of Service: Technofluid adopts the best technologies to guarantee the continuity of the service and the accuracy of the Site. However, it cannot be held responsible for malfunctions of the Internet network or technical problems of third parties that prevent the correct completion of the order.

9.2 Unforeseeable Events: If delivery becomes temporarily impossible or excessively onerous due to force majeure (e.g. strikes, lockouts, fires or serious delays on the part of suppliers), the delivery terms shall be extended for the duration of the impediment. In such extreme cases, Technofluid shall promptly notify the Customer.

10.1. Intellectual Property and Third Party Trademarks: The design, layout, logo and original texts of the Site are the exclusive property of Technofluid S.r.l.

• Contents of Third Parties: Product images, trademarks, datasheets and supplier logos belong to their respective owners and are used by Technofluid for illustrative and informational purposes only, by virtue of existing business relationships.
• Prohibitions: Reproduction, extraction or unauthorised use of any material on the Site (whether by Technofluid or third parties) for commercial or advertising purposes is prohibited without the prior written consent of the copyright holders.

10.2. Privacy and Data Processing (GDPR): The processing of the Customer's personal data takes place in full compliance with EU Regulation 2016/679 (GDPR). The data provided is used exclusively for contract execution, invoicing and logistics.

10.3. Applicable Law and Jurisdiction: Any contract of sale concluded through the Site is governed by Italian law. In the event of disputes that cannot be settled amicably:

• Professional (B2B) and foreign customers: For any dispute arising from the interpretation, execution or termination of the contract, the Court of Messina shall have exclusive jurisdiction.
• Consumers (B2C): Pursuant to the Consumer Code, the mandatory territorial jurisdiction is of the court of the place of residence or domicile of the consumer, if located in the territory of the State.
